The legal deadline
Most states require the landlord to return the deposit within 14 to 30 days of move-out, with a written itemization of deductions. Many states allow double or triple damages if they fail.
What they can deduct
Only damage beyond normal wear and tear, unpaid rent, and cleaning costs if the lease allows it. Generic “paint” and “cleaning” with no invoice or prior inspection rarely survive.
The evidence you need
Dated photos from move-out day, the signed inventory, the lease, messages asking for the deposit, and receipts for utilities you paid.
The right order
1) Ask in writing with a deadline. 2) If nothing, send a certified demand letter. 3) If still nothing, file in small claims for the deposit plus whatever your state allows.
We draft the letter, mail it certified, and hand you the court file.
